Tax

Tax is a seat, not a slogan.

A non-resident European and a US buyer do not file the same Spanish return. Buying through a Spanish SL is a structure, not a discount. This page names the questions. A lawyer in both countries answers them.

At purchase

Resale is usually transfer tax (ITP), often around 7% in Andalucía. New build from a developer is usually 10% VAT plus stamp duty (AJD). Rates move. Confirm them before the offer, not after the flight.

While you hold and let

Non-resident rental income is taxed in Spain (IRNR), often on form 210. Residents of the EU and EEA have generally been able to deduct costs. Residents elsewhere, including many US persons, have often been taxed on a gross basis at a higher rate. Treaties, including the US–Spain treaty, can change the picture. This is not advice, and the rule has been litigated.

A Spanish SL

A company can make sense for several assets, a development, or a commercial building. It brings corporate tax, accounts, banking, and a different exit. It is not automatically kinder than owning in your own name. Czech, German, and US shareholders each have a home-country question on top.

On the way out

A sale can trigger municipal plusvalía and non-resident capital gains tax, often with a withholding at the notary if the seller is not resident. Wealth and solidarity taxes depend on thresholds that regions rewrite. None of this is a reason to skip counsel.
